Summary of Department of Justice Settlement Letters

The DOJ has repeatedly affirmed in settlement letters that schools must comply with the Americans with Disabilities Act (ADA) by ensuring students with Type 1 Diabetes (T1D) have equal access to education. These letters explain that districts are required to remotely monitor continuous glucose monitors (CGMs), respect parent input on insulin dosing, and refrain from contacting providers to alter medical orders without parental consent. U.S. Attorneys have further directed districts to train staff, implement system-wide policies, and remove barriers that prevent students with T1D from receiving safe and appropriate care.

While these agreements apply directly to the districts involved, they reflect how federal authorities interpret the ADA and may be useful for other school systems to consider when developing or reviewing their own policies.
